        A delegation, led by Commission Chairman Dr. Htay Aung, participated in the Workshop on Liability of Legal Persons held online in Putrajaya, Malaysia, from June 20 to 21, 2023. On the first day of the meeting, which took place on June 20, 2023, experts from the United Nations Office on Drugs and Crime (UNODC) Malaysia emphasized that Section 17 (a) of the Malaysian Anti-Corruption Commission Amendment Act (2018) applies to liability of legal persons (LLP). The discussions covered guidelines and responsibilities, investigative guidance and development issues, accountability of organizations recognized as individuals by law, global orientations, performance improvement actions, and foreign bribes. Furthermore, suggestions regarding the protection of whistleblowers were also discussed.

        On the second day of the meeting, which took place on June 21, 2023, anti-corruption expert Ms. Corinna de Vathaire de Guerchy from the Organization for Economic Cooperation and Development clarified and discussed the provisions of the Anti-Bribery Convention. The focus was on reviewing member states' actions concerning liability of legal persons. Additionally, Mr. Gerald M. Mood Jr from the United States Ministry of Justice discussed the provisions of the Foreign Corrupt Practices Act.

        During the discussion, the Myanmar delegation highlighted that Myanmar currently lacks a specific provision regarding liability of legal persons under the law. The existing anti-corruption law could be supplemented through a comprehensive review to include separate provisions for such entities. The actions taken by Malaysia and the discussions held during this meeting have made a significant contribution to the anti-corruption efforts in Myanmar. The delegation expressed their intent to seek international cooperation and requested technical assistance. The workshop was attended by Commission Chairman Dr. Htay Aung, as well as Commission Member U Than Soe and other responsible individuals.
